Rules and Regulations for Daily Rental of Premises
§ 1. GENERAL TERMS OF USE RENTAL OF PREMISES 1 The Rules define the scope of the rules for daily rental of premises at InTheSky Apartments. 2 In the following Regulations the following definitions are used: for parties and entities: - Tenant - a person who makes a reservation for premises or who has concluded a tenancy agreement to lease the premises, - Landlord - INTHESKY APARTMENTS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (NIP:), with its registered office in Wrocław. (3) When making a booking the premises, the following details must be provided: - arrival and departure dates, - personal details, - contact details, - other information, i.e. the number of people who will be staying on the premises. 4 To effective reservation, the tenant must obtain confirmation of the reservation of the premises by the Lessor and payment of the reservation fee in the amount and by the date indicated in the booking system. The The booking fee must be paid in a manner consistent with that indicated in the reservation system. 5 The reservation fee The reservation fee is an obligatory prepayment of the rental amount of the premises to be payable by the Lessee. The reservation fee must amount to 100% of the rental price of the premises.- The condition for an effective and correct booking is a confirmation of the online booking by the Lessor. The confirmation shall be sent to the hirer to the e-mail address indicated during the booking process. The hirer shall be obliged to present the e-mail with the online booking confirmation sent by the Lessor at the time of check-in.- The intermediary is not responsible for the unavailability or failure of the booking system.- The prices shown on the website www.inthesky.apartments include VAT. They may also include other services specified in the offer description. If the offer includes other additional services, such information is given in the description of the price displayed in the system during booking. Services not included in the offer must be paid for immediately on the spot by the hirer. 13. The intermediary reserves the right to cancel a reservation made via the website. www.inthesky.apartments or in direct contact with the accommodation facility, in the event of technical faults in the booking system that are beyond the control of the Lessor and in the case of so-called overbooking. In such a case the Lessee shall be entitled to a full refund of the funds paid to the indicated bank account.- The hirer shall not be entitled to withdraw from the hotel service booking contract, pursuant to Article 38(12) of the Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827 as amended).- In matters not covered by points a) to g), the general provisions on the Reservation process as set out in the said Rules and Regulations for the Rental of Premises shall apply mutatis mutandis. § 3. ACCOMMODATION Check-in time is from 3 p.m. to 11 a.m. Key collection and return is possible from Monday-Saturday 9:00-21:00, Sunday 10:00- 20:00, at the reception of In The Sky Apartments. (3) Upon receipt of the keys, the Tenant shall present identification documents with a recent photograph, i.e. (identity card, passport or driving licence) for themselves and the persons who will be staying at the premises, and shall legibly complete registration cards for all persons staying at the rental premises. (4) Leaving and vacating the premises and handing over the keys to the premises should take place on the last day of the lease provided for in the booking, no later than 11:00 a.m. on the same day. In the event of failure to vacate the premises by the time indicated in the first sentence, the Tenant shall be charged an additional fee of PLN 100.00 for each additional hour of occupancy commenced. When leaving the premises, the Tenant is obliged to lock the premises. (5) In the event of deterioration, damage or destruction of the premises or common parts of the building caused by the Tenant or persons residing in the premises with the Tenant, even if unintentionally, as well as to cover the costs (fines, surcharges) described in §4 and §5 of these Regulations, the Landlord shall collect a security deposit in the amount of PLN 500.00 at the option of the Tenant in cash or in the form of a pre-authorisation of a payment card. In the case of pre-authorisation, the Lessee agrees that the Lessor may take over some or all of the pre-arranged amount without the physical participation of the Lessee's payment card. The Tenant shall notify the Lessor of the occurrence of any damage as soon as it is discovered. (6) The deposit previously collected in cash shall be returned by bank transfer to the account indicated by the Tenant within 7 working days of check-out, after the Landlord has inspected the condition of the premises that were the subject of the tenancy. In the event of damage, deterioration, damage or destruction of the object of rental or the common parts, the deposit shall be retained until the amount of damage caused by the Tenant or accompanying persons or their guests has been determined. (7) The return of the deposit blocked by pre-authorisation of the payment card shall take place within a period that depends on the Lessor's and the Lessee's bank (depending on the bank, this period may be as long as 14 working days). In the event of any deterioration, damage or destruction of the rental object or common parts, the Lessor shall inform the Lessee by e-mail of the damage found and the amount charged for the repair of the damage. (8) If the damage caused by the Lessee exceeds the value of the deposit, the Lessee shall be obliged to fully cover the value of the damage caused. Reparation of the damage shall include the losses that the Lessor has suffered and the benefits that the Lessor could have achieved if the damage had not been caused. (9) The Tenant shall be liable for the acts and omissions of persons residing in the premises with the Tenant t. accompanying persons and guests, and in particular for minors. Minors may only reside in the premises with adults. (10) In the event that the tenant does not accept to pay the costs, the dispute will be settled by the Court. § 4. CONDITIONS OF USE OF THE PREMISES (1) The Tenant shall comply with the above Rules and Regulations, as well as with the Housekeeping Rules and Regulations laid down by the Residential Community. (2) Curfew is enforced in the Sky Tower building between 22:00 and 06:00. The Tenant is obliged to observe the curfew obligation. (4) It is strictly forbidden to cover up, disable or otherwise interfere with the proper operation of the smoke detectors in the leased Premises, under penalty of a financial penalty of PLN 10,000.00. 5. stay of children under six years of age are free of charge (no extra bedding). (2) The Landlord shall be liable for damage to property owned by the Tenant arising in connection with the performance of the cleaning service, covering only damage of a property nature in accordance with the provisions of the Civil Code. The Landlord shall not be liable for unsecured valuable property left behind and belonging to the Tenant or person accompanying the Tenant, such as (jewellery, laptop, etc.). (4) The lessor shall be liable for the acts or omissions of persons to whom he has entrusted or by means of whom he performs cleaning services as for his own acts. § 8 COMPLAINTS (1) The Tenant shall have the right to lodge a complaint with the Landlord to the extent provided for in the following paragraph. (2) In the event of any deficiencies in the quality of the services provided, the Hirer may lodge a complaint by email to the address indicated: recepcja@inthesky.apartments. (3) The Lessor shall inform the Hirer by e-mail of the manner in which the complaint has been dealt with. A return e-mail will be sent to the e-mail address provided by the Hirer within 14 days of receipt of the complaint by the Lessor. (4) In the event of a complaint about ancillary services that are sold in Special Services, a complaint that is made in accordance with the above paragraphs shall be forwarded by the Lessor to its partners providing the said services. The Lessor shall not be liable in connection with the quality of the services provided by the external providers. § 9. PROCESSING OF PERSONAL DATA The scope and manner of processing of personal data is defined in the Lessor's Privacy Policy, annexed to the above Regulations. It is also available on the website: www.inthesky.apartments. In addition, the Lessor declares that all scope and manner of processing of personal data complies with the EU legal regulations. § 10. FINAL PROVISIONS Before booking the premises, the Tenant is obliged to read the above Rules and Regulations for the use of the rental premises. By booking the premises, the Tenant accepts the contents of the above Rules and Regulations and agrees to the terms and conditions contained therein.
